These Terms of Use (“Terms”) govern your access to and use of the websites and services operated by Ascend Digital Partners LLC (“Ascend Digital Partners,” “we,” “us,” or “our”), including our home equity (HELOC) and mortgage refinance pages and any forms, quizzes, or calculators we provide (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Acceptance of these Terms

By using the Services, you represent that you have read, understood, and agree to these Terms. We may update these Terms as described in Changes to these Terms. Your continued use of the Services after changes take effect means you accept the revised Terms.

2. We are not a lender

By submitting information through the Services, you acknowledge and agree that your information may be sold, licensed, transferred, disclosed, or otherwise provided to one or more participating lenders, mortgage brokers, mortgage loan originators, lead purchasers, financial institutions, or other financial service providers.

Submission of information through the Services does not constitute a credit application, guarantee that you will be matched with a lender, or guarantee approval for any product. All lending decisions, rates, fees, terms, and conditions are determined solely by participating providers.

Financial Information Disclosure

Information submitted through the Services is used solely for marketing, lead-generation, matching, and referral purposes. Ascend Digital Partners does not evaluate creditworthiness, determine eligibility for financial products, provide underwriting services, or make lending decisions.

3. No Fiduciary Relationship

Your use of the Services does not create any fiduciary, advisory, agency, brokerage, attorney-client, financial advisor-client, or other special relationship between you and Ascend Digital Partners. We act solely as a marketing and lead-generation platform.

4. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current, and complete.

5. Information you provide

You are responsible for the accuracy of the information you submit. You agree not to submit information about any other person without their authorization. We may use, share, and store the information you provide as described in our Privacy Policy.

6. Consent to be contacted

By clicking “See My Options,” you agree to our Privacy Policy and Terms of Use and consent to be contacted by Ascend Digital Partners and its partners at the phone numbers and email addresses you provide, including through automated telephone dialing systems, artificial or prerecorded voice messages, text messages (SMS), and email communications, even if your number is listed on a federal or state Do-Not-Call registry.

Your consent is not a condition of purchasing any product or service. Message and data rates may apply. Message frequency varies. You may revoke consent at any time as described in our Privacy Policy.

7. Calculators & estimates

Any figures, savings, payments, or equity amounts shown by our calculators or quizzes are illustrative estimates only, based on the information you enter and general assumptions. They are not offers, quotes, pre-qualifications, or commitments to lend, and your actual results may differ materially. You should not rely on these estimates in making financial decisions.

8. Acceptable use

You agree not to:

• Use the Services for any unlawful, fraudulent, or unauthorized purpose;
• Submit false, misleading, or another person’s information without authorization;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
• Use any automated means (bots, scrapers, crawlers) to access or collect data from the Services without our permission;
• Introduce malware or any harmful code; or
• Infringe our or any third party’s intellectual property or other rights.

9. Intellectual property

The Services and all content, design, text, graphics, logos, and software are owned by or licensed to Ascend Digital Partners and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent.

10. Third-party services

The Services may link to or rely on third-party websites and services, including those of our lending partners. We do not control and are not responsible for the content, products, or practices of any third party. Your dealings with third parties, including lending partners, are solely between you and them.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any information provided through the Services is accurate, complete, or current.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASCEND DIGITAL PARTNERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR YOUR INTERACTIONS WITH ANY LENDING PARTNER, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED USD $100 (ONE HUNDRED U.S. DOLLARS).

13. Electronic Communications

By using the Services, you consent to receive notices, disclosures, agreements, and communications electronically. Electronic communications satisfy any legal requirement that such communications be in writing.

14. Reservation of Rights

We reserve the right to refuse service, reject submissions, suspend access, terminate accounts, or restrict access to the Services at our sole discretion and without prior notice.

15. Force Majeure

We shall not be liable for delays, interruptions, or failures in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, internet failures, telecommunications outages, cyberattacks, labor disputes, governmental actions, or failures of third-party providers.

16. Indemnification

You agree to indemnify, defend, and hold harmless Ascend Digital Partners and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

17. Dispute Resolution; Arbitration; Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Ascend Digital Partners shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its applicable rules.

You agree that disputes shall be resolved solely on an individual basis and not as part of any class action, consolidated action, representative action, or private attorney general proceeding.

You waive any right to a jury trial.

These Terms shall be governed by the laws of the State of Florida without regard to conflict-of-law principles.

18. Changes to these Terms

We may modify these Terms at any time. When we do, we will update the “Last updated” date above. Material changes will be effective when posted, and your continued use of the Services constitutes acceptance.
